You have every right to purchase a home without a buyer’s agent — it’s legal and common in New York. If you’ve reached one of our listings directly, here is what you should understand:

  • We represent the seller. Before any substantive conversation, NY State law requires us to provide you with the NY State Agency Disclosure Form — a one-page document that explains clearly who each agent in a transaction represents. Please read it carefully before proceeding.
  • We cannot advise you. Our fiduciary duty runs exclusively to the seller. We will deal with you honestly and fairly, but we cannot guide your negotiating strategy or advocate for your interests.
  • Consider a real estate attorney. In New York, a real estate attorney reviews the contract, conducts title due diligence, and represents your interests at closing — with undivided loyalty to you. Residential real estate attorneys on Long Island typically charge between $1,500 and $2,500 for a standard closing. The NYS Bar Association Lawyer Referral Service and the Suffolk County Bar Association are reliable starting points for finding one.
Understanding the cost difference

When a buyer works with a buyer’s agent, that agent typically seeks compensation of 2–3% of the purchase price — paid either by the seller as a concession or negotiated into the transaction. On a $700,000 home, that is $14,000–$21,000. On a $900,000 home, it is $18,000–$27,000.

A real estate attorney provides legal representation and contract review for a flat fee of approximately $1,500–$2,500 — regardless of the purchase price.

Note: Since the NAR Settlement (August 2024), buyer agent compensation is fully negotiable and must be agreed to in a written Buyer Representation Agreement before touring homes. Buyers are not required to work with an agent or pay any agent compensation.
